Terms of Service
Please read these Terms of Service (“Terms”) carefully before using HaulMyTrailer.com (the “Platform”), operated by HaulMyTrailer LLC, a Montana limited liability company (“HaulMyTrailer,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms.
1. About HaulMyTrailer
HaulMyTrailer is a peer-to-peer marketplace that connects trailer owners (“Owners”) with individuals seeking to rent trailers (“Renters”). HaulMyTrailer LLC acts solely as a marketplace intermediary and is not a party to any rental transaction between Owners and Renters. HaulMyTrailer does not own, operate, insure, or maintain any trailers listed on the Platform.
2. Eligibility
To use the Platform you must:
- Be at least 18 years of age
- Have a valid, government-issued driver’s license (Renters)
- Complete HaulMyTrailer’s identity and document verification process
- Have the legal authority to enter into a binding contract
- Not be prohibited from using the service under applicable law
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at ‘ . HMT_EMAIL . ‘ of any unauthorized use. One account may hold both Renter and Owner roles simultaneously.
4. Verification
HaulMyTrailer requires identity verification for all users and driver’s license verification for Renters. Owner verification requires proof of ownership or legal right to rent. Verification documents are reviewed by our team within 1–2 business days. Submitting false or misleading verification documents may constitute fraud under Montana law.
5. Lien Policy — Trailers with Outstanding Loans
Owners who wish to list a trailer that has an outstanding lien or encumbrance must comply with the following:
If your trailer has an outstanding lien, loan, or encumbrance, you must, before listing, choose ONE of the following options and certify your choice truthfully. False certification constitutes perjury under Montana Code Annotated § 1-6-105 and may result in criminal prosecution, civil liability, and permanent removal from the Platform.
Option B — Lender Authorization: You have obtained written, signed authorization from your lender explicitly permitting the rental of the trailer to third parties while the lien remains outstanding. You must upload this authorization during owner verification and keep it current for the duration of the listing.
Option C — Perjury Attestation: You attest, under penalty of perjury, that:
- You are the registered owner of the trailer and have the legal right to rent it;
- No provision of your lien agreement expressly prohibits rental to third parties;
- No repo order, repossession notice, or active lien enforcement action is pending against the trailer;
- You will immediately suspend the listing and notify HaulMyTrailer if a repo order, lien default, or enforcement action is initiated;
- You accept full legal and financial liability for any harm caused to Renters or third parties arising from undisclosed lien activity.
HaulMyTrailer performs periodic manual lien checks on listed trailers. Any Owner found to have misrepresented lien status will be permanently banned and may be referred to Montana law enforcement.
6. Rental Transactions
All rental transactions occur between the Owner and Renter. HaulMyTrailer facilitates payment processing and dispute resolution but is not a party to the rental contract. The terms of each individual rental are governed by the Rental Agreement, which both parties accept at booking.
7. Payments and Escrow
Rental payments are processed by Stripe (PCI-DSS certified). Funds are held in escrow until:
- The trailer has been returned to the Owner;
- No active repossession or lien enforcement action has been initiated on the trailer;
- The Owner confirms satisfactory return through the Platform.
Owner payouts are released via Stripe Express within 2–5 business days of escrow release. A non-refundable 15% platform commission is deducted from all owner payouts.
8. Damage Deposit
Renters pay a $100 refundable damage deposit at checkout. This deposit is returned following successful rental completion and Owner confirmation. In the event of damage, the deposit may be partially or fully applied toward repair costs. Additional damage beyond the deposit amount will be charged to the Renter’s payment method on file.
9. Photo Documentation
Both Renters and Owners are required to complete pre-rental and post-rental photo documentation through the Platform at the time of pickup and return. Photos are timestamped and stored as evidence for dispute resolution. Failure to complete required photo documentation may limit your ability to dispute damage claims.
10. Insurance
HaulMyTrailer LLC does not provide insurance of any kind. Renters are responsible for maintaining adequate auto insurance that covers the towing of third-party trailers. Owners are responsible for maintaining appropriate trailer insurance during active rental periods. See our Insurance & Coverage page for guidance.
11. Towing Requirements and CDL
Renters are solely responsible for ensuring their towing vehicle is rated for the trailer they are renting. Trailers requiring a CDL-A are filtered on our Platform and may only be booked by verified CDL-A holders. Operating a combination vehicle requiring a CDL without the appropriate license is a violation of Montana law and federal regulations.
12. Age Restriction
Renters must be at least 18 years of age. Age is verified through the identity verification process. Any attempt to circumvent age verification is a violation of these Terms and may constitute fraud.
13. Prohibited Uses
You agree not to use the Platform to:
- Conduct off-platform rental transactions to avoid platform fees
- List trailers you do not legally own or have the right to rent
- Engage in fraudulent activity, including false identity verification
- Use rented trailers for illegal purposes
- Harass, threaten, or harm other users
- Reverse engineer or scrape the Platform
14. Termination
HaulMyTrailer may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or behavior that harms other users or the Platform. Funds in escrow at the time of suspension will be handled according to our dispute resolution process.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY MONTANA LAW, HAULMYTRAILER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. HAULMYTRAILER’S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU TO HAULMYTRAILER IN THE 12 MONTHS PRECEDING THE CLAIM.
16. Indemnification
You agree to indemnify, defend, and hold harmless HaulMyTrailer LLC, its officers, directors, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from your use of the Platform, violation of these Terms, or any rental transaction.
17. Dispute Resolution
Disputes between users are subject to our Dispute Resolution Policy. Disputes between you and HaulMyTrailer LLC shall be governed by the laws of the State of Montana and resolved in the state or federal courts located in Yellowstone County, Montana. You consent to exclusive jurisdiction in Yellowstone County, MT.
18. Governing Law
These Terms are governed by the laws of the State of Montana, without regard to conflict of law provisions. The Montana Uniform Commercial Code and applicable Montana statutes shall apply to all transactions facilitated through the Platform.
19. Changes to Terms
HaulMyTrailer may update these Terms at any time. Continued use of the Platform following notice of changes constitutes acceptance of the updated Terms. Material changes will be communicated via email to registered users.
